Terms of sale

The present terms and conditions of sale are entered into on the one hand by the company Annie Rouanet, sole trader, whose registered office is located at 2 rue de la Carretal 34210 Cesseras, registered under the SIREN number 412425365, hereinafter referred to as "Rouanet-Montcélèbre", and on the other hand by any individual or legal entity wishing to make a purchase via the rouanetmontcélèbre.com website, hereinafter referred to as "the Client".



Purpose of the contract
The purpose of these general terms and conditions of sale is to set out the contractual provisions between Rouanet-Montcélèbre and the Client and the conditions applicable to any purchase made via the rouanetmontcélèbre.com website, for the consumer. The acquisition of a good, product or service through this site implies unreserved acceptance by the client of these conditions of sale.



Legal information
Alcohol abuse is dangerous for your health. Drink in moderation.

Ordinance no. 59-107 of 7 January 1959 and Law no. 74-631 of 5 July 1974 prohibit the sale and offer of alcoholic beverages to minors and similar persons. Consequently, by completing your Order Form, you acknowledge that you have the legal capacity to enter into this contract.

You have the right to access, modify, delete and correct your personal data. Through us, you may receive offers from other companies. If you do not wish to receive such offers, simply write to us stating your full name, address and customer number.

This right must be exercised by writing to :

Rouanet-Montcélèbre collects personal data concerning the Purchaser and, where applicable, the recipient of the Order. The purposes, recipients, retention periods and conditions under which Rouanet-Montcélèbre collects and processes personal data are set out in the site's GTUs and the site's PRIVACY POLICY, which details all the information relating to the processing of personal data as well as the rights of the persons concerned in relation to this processing.


Characteristics of items offered for sale
The items offered for sale are those shown in the catalogue published on the rouanetmontcélèbre.com website. These items are offered while stocks last. Each item is accompanied by a description drawn up by rouanetmontcelebre.com. The photographs in the catalogue are as accurate as possible but cannot guarantee a perfect similarity with the item offered.


Geographical area
The online sale of items presented on the site is reserved for buyers who reside in mainland France, Ireland, the Netherlands, Germany, Belgium, Luxembourg, Spain, Italy, Portugal, the Czech Republic, Slovenia, Slovakia, Estonia, Lithuania, Latvia and Monaco.


Prices
The prices shown in the catalogue are inclusive of VAT in euros, applicable on the day of the order; any change in the rate may be passed on to the price of the articles. Rouanet-Montcélèbre reserves the right to modify its prices at any time, it being understood that the price shown in the catalogue on the day of the order will be the only price applicable to the Customer. The prices indicated do not include the cost of processing orders. Prices are valid only for metropolitan France.

Delivery charges, customs taxes and formalities are the sole responsibility of the Customer.

Orders
Customers place orders on the https://www.rouanetmontcelebre.com website. To purchase one or more items, they must follow the following ordering process:
- Choosing items and adding them to the basket
- Validation of the contents of the basket
- Identification on the website and registration on the identification form, on which they must enter all the requested details
- Choice of payment method and acceptance of the GTCS
- Confirmation of payment

The customer will receive an order confirmation e-mail.

At any time during the ordering process, the client will be able to view the details of their order as well as its total price and correct any errors, before confirming it to express their acceptance.

Rouanet-Montcélèbre reserves ownership of the items until the order has been paid for in full, i.e. when the price of the order has been received by Rouanet-Montcélèbre.

Rouanet-Montcélèbre reserves the right to cancel or refuse any order from a Client with whom there is a dispute relating to the payment of a previous order, or a Client who does not have the capacity to contract. Any order implies acceptance of the prices and descriptions of the items available for sale.

Rouanet-Montcélèbre undertakes to honour orders received on the website only within the limits of available stocks, except in the event of a pricing error, in which case the order will be cancelled and the client reimbursed in full.


Methods of payment
Payment for purchases is made by one of the following methods, at the Customer's convenience:

- By credit card via Shopify payments


Order control
Given the increase in fraud recorded in the context of online commerce and in order to ensure the security of payments, for any order placed by a client on the rouanetmontcelebre.com website, Rouanet-Montcélèbre will check the elements of the order before delivery.

As part of this check, Rouanet-Montcélèbre reserves the right, taking into account the destination, amount, rarity or type of products ordered, to require proof of identity and proof of address from the client, or a Kbis extract for legal entities.

In the event of the client's express or tacit refusal to provide the requested supporting documents, or in the event of non-compliant supporting documents, Rouanet-Montcélèbre will cancel the transaction and immediately refund the client's bank account. Tacit refusal being the absence of a response from the client within a period of 15 days following the request for supporting documents.


Dispatch and delivery times
All express orders placed and paid for on the Rouanet-Montcélèbre website before 12 noon from Monday to Friday (excluding weekends and public holidays) will be prepared and dispatched the same day, subject to validation of payment.

Example: An express order placed on Friday before 12:00 is prepared on Friday and delivered on Monday. An express order placed on Friday after 12.00 will be prepared on Monday and delivered on Tuesday. An order placed on Monday after 12:00 is prepared on Tuesday and dispatched on Wednesday.


Rouanet-Montcélèbre undertakes to deliver the orders placed by the Customer within the agreed timescales. If the said articles have not been delivered within a period of 7 days from the delivery date stipulated when the order was placed, and if this delay is not due to force majeure, the Client may cancel the sale by sending a registered letter with acknowledgement of receipt to the following address: Annie Rouanet - 2 rue de la Carretal 34210 Cesseras - France. The sums paid by the Client will then be reimbursed in full.

The indicative delivery time for French customers is as follows: 2 to 5 working days.

The customer has a period of 30 working days from the date of dispatch of the order to report non-receipt and request cancellation of the sale and reimbursement of the items. After this period, no cancellation of the sale will be accepted.
The customer is responsible for checking that the items delivered are in good condition. Any anomaly noted (missing item, damaged package, broken item, etc.) must be reported to Rouanet-Montcélèbre within 3 days of receipt.


Circumstances beyond our control
We cannot be held responsible for loss, damage, errors or non-delivery of a shipment if it is established that there are circumstances beyond our control. By "circumstances beyond our control" we mean in particular :
- Acts of God or force majeure, in particular earthquakes, cyclones, storms, floods, wars, road, rail and air accidents, embargoes, etc.
- any defects or peculiarities related to the nature of the shipment, even if they were known to us at the time of our acceptance,
- any act, omission or negligence of any third party, for example: the consignee, any interested third party, any employee of customs or any other administration, the postal services, any carrier or other third party to whom the consignment is entrusted by our transport service provider, to serve areas not directly served by itself, even if the sender has not requested or been informed of the use of a third party.


Indirect damage
Rouanet-Montcélèbre will only be liable for reimbursement of the delivery service subject to the reservations set out above (Delay in Delivery) and under no circumstances for any indirect damage that the client may claim. These indirect damages and losses include, in particular, any loss of income, profits, interest or markets and any loss linked to the impossibility of using all or part of the shipment.


Breakage during shipment
If a parcel arrives damaged (broken bottle(s)), the recipient must refuse the parcel. The carrier will inform Rouanet-Montcélèbre. On receipt of this information, Rouanet-Montcélèbre undertakes to immediately reship an identical parcel to the recipient. Under no circumstances may the client demand reimbursement of the product and the delivery charge.



Withdrawal period: exchange or return
Clients, non-professional individuals, benefit from a withdrawal period of fourteen days from the delivery of their order to return the product to Rouanet-Montcélèbre for exchange or reimbursement without penalty.
The Customer will be reimbursed in full (excluding delivery costs) as soon as possible and no later than 14 days after the date on which they exercised their right of withdrawal.

Conditions of exchange and return for reimbursement
Items returned must be intact, unopened and in perfect condition. They must be returned in a condition that allows them to be marketed again.

The Customer must make the return via Chronopost.
If the Customer were to return the items by any other means, and were to incur return costs as a result, he/she would not be entitled to any reimbursement or exchange from Rouanet-Montcélèbre.

The client must keep proof of the deposit of the parcel with the service provider responsible for the return. In the absence of this proof, no exchange or reimbursement may be made in the event of loss of the parcel.

Liability
Rouanet-Montcélèbre shall not be held liable in the event of non-performance of the contract, stock shortage or unavailability of the product, force majeure and, in particular, in the event of all-out or partial strike, flood, fire or other natural disasters and, in general, all events that prevent the order from being carried out correctly.


Electronic signature
The "OK" associated with the authentication and non-repudiation procedure and the protection of all messages constitutes an electronic signature. This electronic signature has the same value as a handwritten signature between the parties.


Proof
Computerised registers, kept in Rouanet-Montcélèbre's computer systems under reasonable security conditions, will be considered as proof of communications, orders and payments between the parties.


Amicable settlement of disputes
These general terms and conditions of sale are governed by French law. In the event of difficulties in the application of these general terms and conditions of sale, we invite you to seek an amicable solution by contacting Rouanet-Montcélèbre beforehand.


Signed proof of delivery
We undertake to provide, free of charge, information on the delivery position by telephone. You will be able to consult and print a proof of delivery signed for by the recipient of your order on the website of our partners DHL, Chronopost, GLS, Kuhne Nagel and Mondial Relay.
